1. Who we are
behaviouraltwin.com is operated by [COMPANY NAME], a company registered in England and Wales under company number [COMPANY NUMBER], with its registered office at [REGISTERED ADDRESS]. Our VAT number is [VAT NUMBER]. You can contact us at hello@behaviouraltwin.com.
In these terms, "we", "us" and "our" mean [COMPANY NAME]. "You" and "your" mean the person using the Service. "Service" means the website, the Behavioural Twin assessment and profile, Counterparty Twin, and any related features, content and outputs.
2. These terms
These terms form a legally binding agreement between you and us. By accessing the site, starting the assessment or using any feature, you confirm that you accept them and agree to comply with them.
We may amend these terms from time to time, for example to reflect changes in the Service, our practices or the law. The version in force is the one published here, and the date at the top shows when it was last changed. Where a change materially affects your rights, we will take reasonable steps to bring it to your attention. Continuing to use the Service after a change takes effect means you accept the amended terms.
Some clauses apply differently depending on whether you are a consumer (using the Service wholly or mainly for personal purposes) or a business user (using it in connection with your trade, business, craft or profession). Where that distinction matters, we say so.
3. Eligibility
You must be at least 18 years old to use the Service. By using it you confirm that you are. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms, and "you" includes that organisation.
You are responsible for ensuring that your use of the Service complies with any policies your employer or client has about the use of AI tools, and with any professional or regulatory obligations you are subject to.
4. What the Service is
Behavioural Twin uses a structured assessment to build a model of how you prefer to communicate, receive information, evaluate options, handle uncertainty, be challenged and work with AI. It translates that model into an editable profile and a set of operating instructions you can give to AI systems.
Counterparty Twin derives a complementary or opposing counterpart profile from your own Behavioural Twin, so you can see how someone whose style differs from yours is likely to want information framed, and adapt your approach accordingly. It is generated from your data, not from information about any other person.
Both are decision-support tools. You remain responsible for how you communicate, what you decide and how you treat other people.
5. What the Service is not
This clause is important. The Service is not, and must not be relied on or presented as:
- a clinical, diagnostic, psychiatric or psychological assessment;
- a medical device or a source of health, mental health or therapeutic advice;
- a validated occupational or selection instrument for recruitment, promotion or performance management;
- a determination of anyone's personality, character, capability, integrity, competence or fitness for a role;
- a factual statement about, or a prediction of, what any person will actually do;
- legal, financial, regulatory, tax or professional advice.
Behavioural Twin outputs are structured models of stated and inferred preference. Counterparty Twin outputs are explicitly probabilistic inferences carrying a stated confidence level. They may be incomplete, out of date or wrong.
6. Your data lives in your browser
Your assessment responses and generated profile are stored in your own browser on your own device. We do not keep a copy. This means:
- we cannot retrieve, restore, repair or resend your profile;
- your profile will not follow you to another browser, device or private browsing window;
- clearing your browsing data, using privacy settings that purge site storage, or losing the device will permanently delete your profile;
- anyone with access to that device and browser can see it.
Because a Twin is a paid product, this matters commercially as well as practically. Export your profile as soon as it is generated and keep the exported copy safe. Losing your browser data means losing what you paid for, and we cannot re-issue it. See clause 15.7.
Keeping a copy is your responsibility. We are not liable for loss of profiles, assessment progress or generated content held in your browser, except to the extent clause 19 does not permit us to exclude liability.
7. Licence to use the Service
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own lawful purposes, and to use your own Behavioural Twin profile and outputs (including for business purposes) subject to these terms.
You may not sublicense, resell, rent or otherwise commercially exploit access to the Service itself without our prior written agreement. Using your own outputs in your own work is permitted; offering the Service or its assessment to others as a paid or unpaid service of your own is not.
8. Acceptable use
You agree to use the Service lawfully and in good faith. You must not:
- use it in breach of any applicable law, regulation or professional obligation;
- copy, scrape, extract, reverse engineer, decompile or otherwise attempt to derive the assessment items, construct definitions, scoring model, weightings or prompts underlying the Service;
- use automated means to access the Service, or attempt to access it other than through the interface we provide;
- use the Service or its outputs to develop, train, benchmark or improve a competing product, model or dataset;
- introduce malicious code, attempt to gain unauthorised access to any part of the Service, or interfere with its operation or security;
- impose an unreasonable load on our infrastructure or that of our providers;
- submit content that is unlawful, defamatory, harassing, abusive, obscene or that infringes anyone's rights;
- remove or obscure any proprietary notice or attribution.
9. Prohibited uses
The Service must not be used to make, support, inform or justify any decision that produces legal effects concerning a person, or that similarly significantly affects them. In particular, you must not use the Service or any output from it in connection with:
- Recruitment and selection — screening, shortlisting, assessing or rejecting candidates;
- Employment decisions — performance management, appraisal, promotion, remuneration, disciplinary action, redundancy or dismissal;
- Credit and financial services — creditworthiness, lending, affordability, pricing or eligibility decisions;
- Insurance — underwriting, pricing, claims handling or eligibility;
- Healthcare and clinical settings — diagnosis, triage, treatment or care decisions;
- Education — admissions, streaming, assessment or exclusion;
- Housing, immigration, benefits, policing or the administration of justice;
- Covert or non-consensual profiling where doing so would be unlawful, or profiling that exploits a person's vulnerability;
- Manipulation, coercion, harassment, stalking or discrimination, or any use targeting a person because of a protected characteristic under the Equality Act 2010.
The purpose of the Service is to help you adapt how you communicate. It is not a means of forming judgements about people that affect their rights, opportunities or livelihood. Understand and adapt; do not classify and decide.
Breach of this clause is a material breach. We may suspend or terminate your access immediately, and you are responsible for any consequences of such use.
10. Counterparty Twin
Counterparty Twin is generated from your own Behavioural Twin. The Service takes the behavioural model built from your assessment and derives a complementary or opposing counterpart profile from it, so you can see how someone with a different style is likely to want information framed, and how to adapt your own approach.
10.1 It is not a profile of a real person
A Counterparty Twin is a behavioural archetype derived from your data. It is not a model of any identifiable individual, it is not based on information about anyone you know, and it carries no knowledge of any real person's actual preferences, intentions or state of mind. You must not present it, to anyone, as an assessment, evaluation or characterisation of a real person.
10.2 Do not enter information about other people
The Service is designed so that you never need to supply information about anyone else, and you must not do so. Where free-text input is available, you must not enter names, contact details, private correspondence, confidential or privileged material, or other information identifying a living individual.
If you do so in breach of this clause, you become the controller of that person's personal data and are solely responsible for complying with data protection law in respect of it, including having a lawful basis and meeting your transparency obligations. Because that content is held in your browser rather than on our systems, we will be unable to locate or delete it on your behalf or on theirs.
10.3 Applying the output
You may use Counterparty Twin output to prepare for and adapt your own communication. You must not use it, or any inference drawn from it, to make or support decisions about a real person that fall within clause 9.
11. AI-generated output
Parts of the Service use artificial intelligence to generate text. You should understand what that means:
- output is generated probabilistically and may be inaccurate, incomplete, inconsistent between runs, or confidently wrong;
- the same inputs may not produce the same output twice;
- output is not reviewed by a human before you see it;
- output is not advice, and should not be the sole basis for any decision of consequence;
- you must apply your own judgement, and verify anything material before acting on it.
We do not warrant the accuracy, completeness, reliability or fitness for any purpose of AI-generated output, to the extent permitted by law.
12. Your content
You retain ownership of the content you submit, including your assessment responses, your profile and any material you enter about a counterparty. To the extent we own any rights in the generated form of your Behavioural Twin profile, we assign or licence them to you so that you can use, edit, export and share your own profile freely.
You grant us a limited, worldwide, royalty-free licence to host, transmit, process and display your content solely to operate the Service and deliver the output you have requested, including transmitting it to our AI model providers. That licence ends when the processing is complete. We do not use your content to train models, and we do not use it for any purpose beyond providing the Service.
You are responsible for the content you submit and for having the right to submit it.
13. Our intellectual property
We own or licence all intellectual property rights in the Service, including the assessment instrument, the item bank, construct definitions and mapping, the scoring and confidence models, the profile schema and export structure, the interaction model, the software, the site design, and all text, graphics and branding. Nothing in these terms transfers those rights to you.
"Behavioural Twin" and "Counterparty Twin", together with our logos and get-up, are our marks. You may not use them without our written permission, other than to identify our product accurately and fairly.
14. Feedback
If you send us feedback, suggestions or ideas about the Service, you agree we may use them without restriction, without obligation to you and without payment. We will not identify you as the source without your permission.
15. Charges, payment and cancellation
15.1 One-off services
Behavioural Twin and Counterparty Twin are supplied as one-off services. Where a charge applies, the price is shown before you commit to buy and includes any sales tax or VAT that we are required to add. You pay once per Twin: there is no subscription, no recurring charge and no automatic renewal. Parts of the site, including introductory content, the walkthrough and examples, may be made available free of charge, and where a feature is free no payment obligation arises.
15.2 How the contract is formed
Starting the assessment, or completing a purchase where one is required, confirms your acceptance of these terms. A contract comes into existence when we confirm your order or begin generating your Twin, whichever happens first. If we cannot accept your order — for example because of a payment failure or a pricing error — we will tell you and will not charge you.
15.3 Payment
Where a charge applies, payment is taken at the point of purchase through our payment provider, Stripe. We do not receive or store your full card details. You confirm that you are authorised to use the payment method you provide. Prices are payable in the currency shown at checkout. Any bank, card, currency conversion or local charges are yours to pay.
15.4 Pricing errors
We take care to price accurately, but errors occur. If we discover an error in the price of something you have ordered, we will tell you before supply and give you the choice of continuing at the correct price or cancelling for a full refund. If an obvious mispricing could reasonably have been recognised as an error, we are not obliged to supply at the wrong price.
15.5 Immediate supply and waiver of any cooling-off period
The service is generated and delivered to you immediately. By accepting these terms and starting the assessment, or by completing a purchase, you expressly:
- request that we begin supplying the service, and the digital content it produces, straight away rather than waiting for any cancellation or cooling-off period to expire; and
- acknowledge that, once supply has begun, any right you may have to cancel and obtain a refund is lost, to the fullest extent permitted by the law that applies to you.
If you are a consumer in the United Kingdom or the European Economic Area, this means your statutory 14-day right to cancel a distance contract for digital content (under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or the equivalent national implementation of the EU Consumer Rights Directive) ends as soon as generation starts. Consumers elsewhere may have comparable rights under their own local law, which are waived on the same basis and only so far as local law allows. If you do not wish to give this confirmation, do not start the assessment or complete the purchase.
Once generation has started, the service is treated as fully performed and the purchase is non-refundable, except where a refund is required by law or where clause 15.6 applies.
15.6 Your mandatory local rights are unaffected
Nothing in this clause removes rights that cannot be excluded under the mandatory consumer law of the country where you live. In the United Kingdom, digital content we supply must be of satisfactory quality, fit for purpose and as described under the Consumer Rights Act 2015; if it is not, you are entitled to a repair or replacement and, where that is not possible or is not provided within a reasonable time, to a price reduction or refund. Consumers in other countries keep the equivalent protections given to them by their own law.
15.7 Loss of your Twin is not a fault
As clause 6 explains, your Twin is stored in your browser and we hold no copy. If you clear your browsing data, change device or lose access to the browser you used, your Twin is gone and we cannot restore it or re-issue it. That is not a defect in what we supplied, and it does not entitle you to a refund or a replacement. Export your profile as soon as it is generated.
15.8 Business users
If you use or buy the service as a business user, consumer cancellation and refund rights do not apply at all. All fees are payable in advance and are non-refundable except where we agree otherwise in writing.
15.9 Taxes
You are responsible for any local taxes, duties or withholdings arising from your purchase other than taxes on our income. Where we are required to collect sales tax, VAT or an equivalent, it will be shown at checkout.
16. Availability and changes
We aim to keep the Service available, but we do not guarantee uninterrupted or error-free access. We may suspend, withdraw, restrict or change all or any part of the Service, including individual features, for business or operational reasons. Where practical, we will give reasonable notice.
Some features are early-stage or labelled as forthcoming. Features described as future, coming next or in preview may change substantially or may not be released.
You are responsible for the arrangements necessary to access the Service, including your device, browser and internet connection, and for ensuring that anyone accessing it through your connection is aware of these terms.
17. Third-party services
The Service may link to, or interoperate with, third-party websites, AI assistants, agents and platforms. We do not control them, do not endorse them, and are not responsible for their content, availability, security or terms. If you export your profile into another AI system, that system's provider determines how it handles your data, and their terms and privacy policy apply.
18. Disclaimers
Except as expressly stated in these terms, and to the fullest extent permitted by law, the Service is provided "as is" and "as available", and we exclude all conditions, warranties and representations that might otherwise be implied, including as to satisfactory quality, fitness for a particular purpose, accuracy and non-infringement.
If you are a consumer, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015, including the right to services performed with reasonable care and skill. If you are unsure of your rights, contact Citizens Advice or your local Trading Standards office.
19. Our liability
19.1 What we never exclude. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded — including, for consumers, liability under the Consumer Rights Act 2015 and the Consumer Protection Act 1987.
19.2 If you are a consumer. We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. The Service is provided for domestic and private use; if you use it for any commercial purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
19.3 If you are a business user. Subject to clause 19.1, we are not liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; loss or corruption of data, profiles or content; or any indirect or consequential loss. Subject to clause 19.1, our total liability to you in connection with the Service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the greater of the amounts you have paid us in the twelve months before the claim arose and £100.
19.4 Decisions you take. We are not liable for decisions you make, communications you send, negotiations you conduct or relationships you manage in reliance on output from the Service, or for any consequence of using output in a way clause 9 prohibits.
20. Your indemnity (business users)
This clause applies only if you are a business user. You will indemnify us against all liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising from or in connection with your breach of clause 8 (acceptable use), clause 9 (prohibited uses) or clause 10 (Counterparty Twin), including any claim by a third party or a regulator arising from your use of output from the Service in relation to a real person, or from your entering another person's personal data into the Service in breach of clause 10.2.
21. Suspension and termination
You may stop using the Service at any time. To delete your profile, use the delete function in the product or clear site data for behaviouraltwin.com in your browser.
We may suspend or terminate your access without notice if we reasonably believe you have breached these terms, particularly clauses 8, 9 or 10, or where necessary to protect the Service, other users or third parties. Clauses 5, 6, 9, 10, 12, 13, 14, 15.6, 15.7, 18, 19, 20, 23 and 24 survive termination.
22. Privacy
Our Privacy Policy explains how we handle personal data, including how your Behavioural Twin is stored in your browser, how AI processing works and how responsibility for counterparty data is allocated. It forms part of your agreement with us.
23. General
- Entire agreement. These terms and the Privacy Policy constitute the entire agreement between us regarding the Service and supersede any prior arrangement, save that nothing excludes liability for fraudulent misrepresentation.
- Severability. If any provision is found unlawful or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions continue in force.
- Waiver. A delay or failure to enforce any right is not a waiver of it.
- Assignment. We may transfer our rights and obligations under these terms to another organisation, and will tell you if we do. You may not transfer yours without our written consent.
- Third parties. No one other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
- Events outside our control. We are not liable for failure or delay in performing our obligations where caused by an event beyond our reasonable control, including failures of third-party infrastructure or AI model providers.
- Notices. We may give you notice by email or by posting on the site. You may give us notice at legal@behaviouraltwin.com.
24. Governing law
These terms and any dispute arising out of or in connection with them, including non-contractual disputes, are governed by the law of England and Wales.
If you are a business user, the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you may bring proceedings in the courts of England and Wales, and if you live in Scotland or Northern Ireland you may also bring proceedings in the courts of the country where you live.
The Service is offered internationally. If you are a consumer living outside England and Wales, this choice of law does not deprive you of the protection of any mandatory provisions of the law of the country where you live, and you may also bring proceedings in the courts of that country. You are responsible for complying with any local law that applies to your use of the Service, and we make no representation that the Service is appropriate or available in every country.
25. Contact and complaints
